The Ministry of Law and Justice on April 22, 2020, issues the Epidemic Diseases (Amendment) Ordinance, 2020 to further amend the Epidemic Diseases Act, 1897.

The followings are the amendments made:-

 Section 2B related to “Prohibition of violence against health care service personnel and damage to property” has been inserted, stating that, no person shall indulge in any act of violence against a healthcare service personnel or cause any damage or loss to any property during an epidemic.

 In Section 3 related to “penalty”, a new sub-section 3(2) has been inserted, stating that, whoever commits or abets the commission of an act of violence against healthcare service personnel or causes damages or loss to any property, shall be punished with imprisonment upto 5 years and with fine upto Rs. 2 lakh.

 Section 3A related to “Cognizance, investigation and trial of offences” has been inserted.

 Section 3B related to “Composition of certain offences” has been inserted, where a person is prosecuted for committing an offence punishable be compounded by the person against whom such act of violence is committed.

 Section 3C related to “Presumption as to certain offences” has been inserted, where a person is prosecuted for committing an offence punishable, the Court shall presume that such person has committed such offence.

 Section 3D related to “Presumption of culpable mental state” has been inserted, stating that in any prosecution of an offence which requires a culpable mental state, the Court shall presume the existence of such mental state.

 Section 3E related to “Compensation for acts of violence” has been inserted, the person so convicted shall be liable to pay by means of compensation.

This Notification shall come into force at once.
