Government of Odisha publishes the Odisha the Epidemic Diseases (Amendment) Ordinance, 2020

The State Government of Odisha on April 08, 2020, has publishes the Odisha the Epidemic Diseases (Amendment) Ordinance, 2020 to further amend the Epidemic Diseases Act, 1897.

The following amendments are as under:

Ø  Under Rule 2 (2) which specifies the power of the State Government to take special measures and prescribe regulations as to dangerous epidemic disease, the following clause has been inserted, namely:

Ø  Clause (c): procurement of goods, services and equipments necessary for prevention and control of the epidemic disease and the manner of such procurement.

Ø  Rule 3 which specifies penalty, has been substituted:

a.       3. Penalty: Whoever contravenes or disobeys any order or regulations made under this Act: Imprisonment of 2 years or with fine which may extend to 10, 000/- or with both.

b.       3-A. Offence to be cognizable and bailable: Every offence under this Act shall be cognizable and bailable.

c.       3-B. Compounding of offence:

(1)    An offence punishable under section 3 may either before or after the institution of the proceeding be compounded on payment of amount as specify by the Government, which shall not exceed the maximum amount of the fine that may be imposed for the offence so compounded.

(2)    Where the offences have been compounded, no proceeding or further proceeding will be initiated or continued against the offender.
