Draft the Goa Land Development and Building Construction (Amendment) Regulations, 2021

The Department of Town and Country Planning, Goa on July 1, 2021 has issued Draft the Goa Land Development and Building Construction (Amendment) Regulations, 2021 to further amend the Goa Land Development and Building Construction Regulations, 2010. 

The amendment in the Goa Land Development and Building Construction Regulations, 2010 are as follows: -

• In Regulation 2 which specifies “definition”, the following changes has been made: -

• Clause 20A (h) which specifies “High Rise Building”, has been substituted, namely: -

“High Rise Building” means a building 15 meters or above in height (irrespective of its occupancy. “

• Clause 66 which specifies ““Fire resistant materials”, has been substituted, namely: -

“Fire resistant materials” means and includes those materials serving appropriate fire resistance rating as per the relevant provisions of National Building Code of India, 2016 as amended from time to time and relevant Bureau of Indian Standards (BIS) Codes”.

• Clause 77 which specifies “High Rise Building”, has been omitted. 

• Clause 86A which specifies “National Building Code of India, 2016” means the National Building Code of India, 2016 as amended from time to time”, has been inserted. 

• In Regulation 3.6.2 (c) which specifies “In case of the buildings specified in regulation 15.2.1, No Objection Certificate from the Director of Fire and Emergency Services shall be obtained by the owner before applying for Construction License to the Local Authority”, has been substituted. 

• In Regulation 3.11 (b) which specifies “Clearance from the Directorate of Fire and Emergency Services before issue of Occupancy Certificate shall be required for the buildings specified in regulation 15.2.1”, has been substituted. 

• In Regulation 6A.5 (2) which specifies “In case of building on stilts or building with basements, the height of the building shall be measured from the top of the stilts/basement. However, in case of High-Rise Building, the height of the building shall be measured from the ground, the Fire and Life Safety Regulations as per Part 4 of the National Building Code of India 2016 shall be applicable”, has been substituted. 

• Regulation 15 which specifies “Fire and life safety requirements”, has been substituted. 

All objections and suggestions to the draft Regulations send before the expiry of the said period of 30 days so that they may be taken into consideration may be forwarded to the Chief Town Planner (Administration), Town and Country Planning Department, 2nd Floor, Dempo Tower, Patto Plaza, Panaji, Goa.
