The Goa Department of Law on October 12, 2020 has issued the Factories (Goa Amendment) Act, 2020 to further amend the Factories Act, 1948 in respect of State of Goa. The provisions of Section 2 and Section 4 of this Act shall be deemed to have come into force on July 07, 2020.

Following are the amendments made in Goa Factories Act, 1948:

• Section 2 of the principal act which specifies the applicability of the Factories Act, 1948 to an establishment with specific number of the workers has been amended with 20 or more workers. 

• Section 2(2) has been amended increasing the number of workers to 40 or more.

• A new section 5A has been inserted relating to power of State Government to exempt any new factory or class or description of new factories from all or any of the provisions of this Act for a period of one thousand days from the date on which such commercial production start.

• For the purposes of this section, the expression “new factory or class or description of new factories” means such factory or class or description of factories which are established and whose commercial production start within a period of one thousand days from the date of commencement of the Factories (Goa Amendment) Act, 2020.

• Section 85 which talks about the applicability of the act to certain premises, sub-clauses (i) and (ii) has been substituted wherein threshold limit of the workers employed has been changed to “twenty” and “forty”.

The Factories (Goa Amendment) Ordinance, 2020 is hereby repealed.
